Capital offense case files, 1977-[ongoing].

The attorney general's office "must attend, on the part of the state, to all criminal cases pending in the supreme court or court of criminal appeals" (Ala. Code, 36-15-1[3] [1975]). The Capital Litigation Division handles the appeals of all capital (death sentence) cases which have gone beyond the circuit court. A capital case can be appealed up through the Alabama state courts to the U.S. Supreme Court and back down again or it may be appealed through the federal appeals court system up to the U.S. Supreme Court. These records document the activities of the division in handling the prosecution of such cases through all of the appellate courts. The case is closed when a defendant is executed, set free, or is given a final sentence other than death. Specific documents in the files may include petitions for review by the Alabama Court of Criminal Appeals, briefs on applications for rehearing, briefs for the state, reply briefs from the attorney general, petitions to the U.S. Supreme Court, briefs to the U.S. Supreme Court. Some of the files contain photographs used as exhibits or evidence. Information in the files includes full details of the original trial, and all legal points and arguments relative to the case.
